1) GENERAL TERMS AND CONDITIONS GET-ITDARTS

1. Definitions
In these terms and conditions the following terms shall have the following meanings:
1.1 Get-iTdarts / We / Entrepreneur:

1.2 Consumer:
A natural person who does not act in the exercise of a profession or business.
1.3 Business customer:
A natural person or legal entity acting in the exercise of a profession or business.
1.4 Distance contract:
An agreement that is concluded via the webshop without the physical presence of the parties.
1.5 Products:
All products offered through the webshop, including (but not limited to):
- Match-used darts (used darts from professional players)
- Match-worn shirts (worn shirts by professional players)
- Used setups / accessories (used or assembled)
- Signed memorabilia (such as shirts, flights, cards, etc.)
- Other collector's items / collectibles
- Any (new) merchandise / own designs
1.6 Collectors item:
A (often unique or very limited) collector's item, the value of which is (partly) determined by rarity, provenance, authenticity, condition, packaging and documentation (such as a certificate of authenticity).
1.7 Used item:
A product that has demonstrably been used/worn by a professional player (e.g., match-used/match-worn). Signs of wear are inherent to the product's character.
1.8 Certificate of Authenticity (COA):
A document provided by Get-iTdarts with certain products to confirm origin/authenticity.
1.9 Right of withdrawal:
The consumer's right to cancel a distance contract within 14 days (with statutory exceptions).
2. Applicability
2.1 These general terms and conditions apply to every offer, order and agreement between Get-iTdarts and the customer.
2.2 In the event of any conflict between these terms and conditions and any additional agreements, the additional agreements shall prevail (if confirmed in writing).
2.3 If any provision is found to be invalid, the remaining provisions will remain in full force. In that case, the invalid provision will be replaced by a provision that most closely approximates its purpose.
3. The offer and product information (important for collectors' items)
3.1 Get-iTdarts is not a "standard webshop." A large portion of our selection consists of unique or very limited collector's items and used items (match-used/match-worn).
3.2 Product photos and descriptions are intended to provide the most accurate representation possible. Minor differences in color/display may occur due to screen settings.
3.3 Used items may show signs of wear (e.g., wear, stains, odor, wrinkles, chips, flight/spinning wear). This is part of the product and not a defect, provided it reasonably matches the description.
3.4 Obvious errors (such as an obvious pricing error or typographical error) do not bind Get-iTdarts.
4. Establishment of agreement
4.1 The agreement is concluded as soon as the customer completes the order and receives an order confirmation.
4.2 Get-iTdarts may refuse or cancel an order if it suspects fraud, misuse, incorrect information, or inability to deliver. In that case, any amount already paid will be refunded as soon as possible.
5. Prices
5.1 All prices include VAT (unless stated otherwise).
5.2 Shipping costs will be shown in the checkout process.
5.3 Collector's value may increase or decrease after purchase. Get-iTdarts is not liable for fluctuations in value after purchase.
6. Payment
6.1 Payment is made via the payment methods offered in the webshop.
6.2 An order will be processed once payment is successful (unless otherwise agreed).
7. Delivery & Risk
7.1 Delivery will take place at the address specified by the customer.
7.2 Delivery times are indicative. Delays do not automatically entitle you to compensation.
7.3 The risk of loss or damage during transport lies with Get-iTdarts until the moment of delivery. After delivery, the risk lies with the customer.
7.4 If a product is no longer available, Get-iTdarts will contact you. If payment has already been made, the amount will be refunded.
8. Right of withdrawal (return/cancellation) – Consumer
8.1 Consumers in principle have the right to cancel the agreement within 14 days after receipt without giving any reason.
8.2 You can cancel your purchase by sending an email to info@get-itdarts.nl with at least:
- order number
- name
- the product(s) you wish to return
8.3 After notification of withdrawal, you have another 14 days to return the product.
8.4 The return costs are borne by the consumer (unless otherwise agreed).
8.5 Refund: Get-iTdarts will refund the purchase price (including standard shipping costs) within 14 days after the return has been received, or as soon as it can be demonstrated that the package has been shipped (whichever is sooner).

9. Very important: inspection is allowed, use is not (depreciation)
9.1 You may only unpack and view the product as you would in a physical store, to assess whether you wish to keep it.
9.2 If you go beyond what is necessary for assessment (e.g. wearing, trying on with risk of odor/stains, playing with it, throwing darts, handling for prolonged periods, damaging the label/COA, throwing away packaging), then this may result in a reduction in value.
9.3 With collectors' items, depreciation is particularly sensitive, because the collection value is highly dependent on condition, completeness, COA and packaging.
9.4 Get-iTdarts is entitled to deduct any depreciation due to use/handling from the refund amount. In the event of a significant reduction in the collector's value, this may (depending on the situation) amount to a significant portion of the purchase price.
10. When returns are (almost) impossible in practice for collector's items
10.1 Get-iTdarts sells many unique used/collector's items. Once an item has been used by the customer or treated in a way that demonstrably diminishes its collector's value, it can no longer be resold as the "same collector's item."
10.2 In such cases, your right of withdrawal remains the legal basis, but the reduction in value may be so high that little or no refund remains.
10.3 Therefore, our urgent advice is: treat collectors' items with the utmost care and in a "shop-like" manner during the cooling-off period.
11. Exclusions from the right of withdrawal (statutory exceptions)
11.1 The right of withdrawal may only be excluded if the law permits this, for example in the case of:
- Custom-made/personalized products that are made especially for you (e.g. custom printing/name)
- Sealed hygiene products where the seal has been broken (if applicable)
11.2 If a legal exception applies, this will be clearly stated with the product.
12. Warranty, conformity and condition of used items
12.1 For consumers: products must comply with the agreement and the description.
12.2 For used items, signs of wear and imperfections are consistent with the product. This is not a defect, as long as it reasonably corresponds to "match-used/match-worn/used" and matches the description.
12.3 Get-iTdarts often sells unique items. Replacement is usually not possible. In the event of a valid problem, we will work with you to find a suitable solution (e.g., a (partial) refund, an exchange if possible, or another reasonable solution).
13. Authenticity, COA and liability
13.1 Where stated, Get-iTdarts will provide a certificate of authenticity (COA).
13.2 The COA is part of the product. When returning the product, the COA must be undamaged and complete. A missing or damaged COA will result in (significant) reduction in value.
13.3 Get-iTdarts is not liable for:
- fluctuations in value in the collectors market after purchase
- depreciation due to customer actions (use, damage, incorrect storage)
- indirect damage (such as lost profits), unless mandatory law provides otherwise
14. Complaints procedure
14.1 You can email complaints to getitdarts@gmail.com or info@get-itdarts.nl.
14.2 Please state: order number, clear description and photos (if relevant).
14.3 We aim to respond substantively within 14 days.
14.4 EU consumers can also use the ODR platform: http://ec.europa.eu/odr
Article 15 – Disputes & applicable law
15.1 All agreements between Get-iTdarts and the customer are exclusively governed by Dutch law.
15.2 Disputes arising out of or in connection with these agreements shall, to the extent permitted by law, be submitted exclusively to the competent court in the Netherlands.
15.3 For business customers (acting in the exercise of a profession or business), the exclusive jurisdiction of the court in the Netherlands is agreed.

2) PRIVACY & COOKIE STATEMENT GET-ITDARTS

1. Introduction
In this privacy statement we explain how Get-iTdarts handles personal data processed via www.get-itdarts.nl.
2. Who is responsible?
Get-iTdarts is the data controller.

3. What data do we process?
Depending on your use, we may process the following data:
3.1 Order and contact details:
Name, address, email, telephone number, order details, communication regarding the order.
3.2 Payment details:
Payment status, transaction/payment references via payment providers.
(We do not generally receive complete map data.)
3.3 Technical data / website use:
IP address, device and browser data, cookies, log data, pages visited and statistics.
4. Why do we process data?
We process personal data for:
- the execution of the agreement (order, payment, delivery, return/cancellation, service)
- customer service and communication
- administrative and legal obligations (including tax retention obligations)
- security, fraud and abuse prevention
- improving the website and services (statistics/analytics)
- (optional) marketing/newsletter, only if you sign up for this
5. Sharing data with third parties
We do not sell your data.
We only share data with parties that are necessary for our services, such as:
- carriers (for shipping, labels, track & trace)
- payment providers
- hosting/website management
- accounting/administration
- analytics partners (only according to cookie settings)
We conclude processing agreements with processors where necessary.
6. Retention periods
We do not store data longer than necessary:
- invoice/order administration: according to statutory retention periods
- customer contact/complaints: as long as necessary for handling and aftercare
- analytics/cookies: according to settings and retention periods of the tool(s) used
7. Cookies
Cookies are small files that are stored on your device.
We use cookies for:
- necessary functions (shopping cart, session, security)
- preferences
- statistics (e.g. to analyze website usage)

11. Minors
Our website is not intended for children under the age of 16 without parental or guardian consent. We do not knowingly collect data from minors.

3) ORDER PROCESSING AND SHIPPING

Shipping – order processing at Get-iTdarts
1. After placing your order, you will receive an order confirmation.
2. We receive a notification of the order at the same time.
3. After successful payment, we usually collect the order within 48 hours.
4. We will then create the shipping label.
5. We carefully pack your order and prepare it for shipment.
6. Shipping usually takes place at least once every 48 hours (excluding weekends). If it takes longer, we will contact you.
7. We ship in cooperation with PostNL.
- Netherlands: usually 1-2 working days
- Europe: usually 3–5 working days
- Worldwide: Usually 5–15 days (depending on customs/handling)
8. After shipment you will receive a shipping confirmation (where possible with track & trace).
9. During holidays, periods of increased activity and extreme weather conditions, processing and delivery of orders may take longer than usual.

4) RETURN POLICY (SUMMARY)

- After that: return it within 14 days
- Return costs: at the buyer's expense
- Let op collectors items:
Inspection is permitted, but use is not. Use/handling may result in (significant) depreciation that we may deduct.
- Product must be complete, including packaging/accessories and (if applicable) COA.
